The terms on which Elecden Electrical Services Pty Ltd provides this website and quotes for work.
1. Who these terms are with
This website is operated by Elecden Electrical Services Pty Ltd (ABN 97 701 064 020, ACN 701 064 020), an Australian company registered in Victoria. In these terms, "we", "us" and "our" mean Elecden Electrical Services Pty Ltd, and "you" means the person using the site or engaging us.
By using elecdenelectricalservicestec.site you accept these terms. If you do not accept them, please do not use the site.
2. What this website is
The site describes the electrical services we offer and how to contact us. It is general information, published in good faith and believed to be correct at the time of publication. It is not electrical, safety, engineering, legal or financial advice, and it is not an assessment of any particular property.
Nothing on this site should be relied on as a substitute for having the work looked at. Electrical work is regulated, and much of it can only lawfully be carried out and certified by a qualified person. Do not attempt electrical work yourself on the basis of anything described here.
3. Nothing here is an offer
Descriptions of services on this site are an invitation to enquire, not an offer capable of acceptance. No contract for work is formed until we have provided a written quote and you have accepted it, or we have otherwise agreed in writing to carry out the work.
4. Quotes, prices and variations
- Quotes are given in Australian dollars and state whether GST is included.
- Unless the quote says otherwise, it remains open for 30 days from its date.
- A quote covers the scope described in it. Concealed conditions that could not reasonably be seen at the time of quoting — for example cabling inside a wall, damage in a roof space, or non-compliant work by others — may require a variation.
- We will tell you about any variation and its cost, and obtain your agreement, before carrying out that additional work, except where an immediate step is necessary to make a dangerous situation safe.
- Invoices are payable by the date shown on the invoice.
5. Your obligations
To let us work safely and efficiently, you agree to:
- give us safe and timely access to the site at the arranged times;
- tell us what you know about the property, including previous electrical work, hidden services and asbestos-containing materials;
- tell us in advance if anyone on site relies on continuous power for medical or business-critical equipment;
- keep children and animals clear of the work area; and
- confirm that you own the property or are authorised by the owner to have the work carried out.
6. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, which is Schedule 2 to the Competition and Consumer Act 2010 (Cth). Among other things, services must be supplied with due care and skill and be fit for any purpose you told us about, and goods must be of acceptable quality.
For a major failure with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem fixed within a reasonable time and, if that is not done, to cancel the contract and obtain a refund for the unused portion.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
7. Workmanship and equipment
We stand behind our workmanship on the terms set out in the quote for your job, in addition to your rights under the Australian Consumer Law. Equipment we supply and install — switchgear, fittings, chargers and similar — also carries the manufacturer's own warranty, and we will help you make a claim under it where one applies.
Our workmanship cover does not extend to fair wear and tear, damage caused by others, alterations made by another party after we finish, misuse, storm, flood, pest damage, or failure of equipment supplied by you or by a third party.
8. Limitation of liability
Subject to clause 6 and to the extent permitted by law:
- we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of data or loss of opportunity arising out of the use of this website;
- we do not warrant that this website will be uninterrupted, error free or free of harmful components, and we are not liable for loss arising from its unavailability; and
- where our liability may lawfully be limited, our liability for services is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
9. Intellectual property
All content on this website — text, layout, styling, drawings, diagrams, icons and the Elecden Electrical Services name and wordmark — is owned by or licensed to Elecden Electrical Services Pty Ltd and is protected by Australian and international copyright law.
You may view the site and print or download extracts for your own personal, non-commercial use. You must not reproduce, republish, adapt or commercially exploit any part of it, or present it as your own, without our prior written permission.
10. Acceptable use
You must not use this website in any way that breaches any law, infringes anyone's rights, or interferes with its operation or security. That includes attempting to gain unauthorised access to the site or any server behind it, introducing malicious code, scraping content in bulk, or using our contact address to send unsolicited commercial messages.
11. Availability and third-party material
We may change, suspend or withdraw any part of this website at any time without notice. We aim to keep it available, but we do not guarantee uninterrupted access.
This site does not embed third-party content or tracking. If we ever link to another website, we do so for convenience only; we do not control those sites and are not responsible for their content or their privacy practices.
12. Termination
We may end your access to this website at any time if you breach these terms. Either party may cancel an agreed job by giving written notice before the work starts. If work has already begun, or materials have been specially ordered for your job, you remain liable for the work carried out and the materials supplied up to the date of cancellation, and for any non-refundable supplier charges we have already incurred.
Clauses that by their nature should survive termination — including intellectual property, limitation of liability and governing law — continue to apply.
13. Privacy
Personal information you give us is handled in accordance with our privacy policy and the Privacy Act 1988 (Cth).
14. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you use the site is the version that applies to that use. Terms already incorporated into an accepted quote are not changed by an update to this page.
15. Governing law
These terms, and any dispute or claim arising out of or in connection with them or your use of this website, are governed by the laws of the State of Victoria (VIC), Australia, and by the Commonwealth laws applying in that State. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the courts entitled to hear appeals from them.
16. Severability and contact
If any provision of these terms is found to be unenforceable, it is to be read down or severed to the minimum extent necessary, and the remaining provisions continue in full force.
